Acceptable Use Policy

ExecCortex is built for legitimate eCommerce operators. This policy defines what you can and cannot do with our platform — including messaging, AI features, and third-party integrations. Violations may result in suspension or termination.

1. Purpose and Scope

This Acceptable Use Policy ('AUP') applies to all users of the ExecCortex platform, including free plan users, paid subscribers, API users, and resellers. It is incorporated into the ExecCortex Terms of Service.

The purpose of this policy is to protect the integrity of the platform, protect the recipients of messages sent through the platform, ensure compliance with applicable law and third-party platform policies, and maintain ExecCortex's ability to provide services to all customers.

2. Permitted Use

ExecCortex may be used for:

  • Analyzing data from legitimately operated eCommerce stores that you own or manage
  • Sending transactional and marketing communications to customers who have given valid consent to receive them
  • Automating workflows that improve customer experience — cart recovery, order updates, post-purchase engagement
  • Generating AI-powered insights and reports for your own business use
  • Building and operating AI chat widgets for your own websites and customer touchpoints
  • Reselling ExecCortex services to clients under an authorized reseller agreement

3. Prohibited Activities — General

The following activities are strictly prohibited and will result in immediate suspension:

  • Violating any applicable local, state, national, or international law or regulation
  • Impersonating any person, company, or brand that you do not have authority to represent
  • Submitting false, misleading, or fraudulent data to the platform
  • Using the platform to facilitate or promote illegal products or services
  • Scraping, mining, or extracting data from third-party platforms beyond what their APIs authorize
  • Attempting to access any ExecCortex system, database, or account that you are not authorized to access
  • Reverse engineering, decompiling, or creating derivative works of the platform software
  • Introducing malware, viruses, or malicious code to the platform or connected systems
  • Using the platform to attack, harass, or stalk any individual

4. Prohibited Activities — Messaging and Communications

When using ExecCortex to send WhatsApp messages, SMS, or email communications, you must not:

  • Send unsolicited commercial messages (spam) to individuals who have not opted in to receive communications from your business
  • Send messages to purchased, rented, or scraped contact lists
  • Use misleading sender identification, subject lines, or call-to-action copy
  • Continue sending messages to individuals who have opted out or replied 'STOP'
  • Send messages that violate Meta's WhatsApp Business Policy, including prohibited content categories (gambling, financial services without proper licensing, weapons, adult content, pharmaceuticals without authorization)
  • Use WhatsApp template messages that have not been approved by Meta
  • Exceed WhatsApp Business messaging rate limits or quality rating thresholds
  • Send SMS messages without TCPA-compliant consent (for US recipients) or equivalent consent requirements in other jurisdictions
  • Send email without CAN-SPAM (US), CASL (Canada), or PECR/GDPR (EU/UK) compliance

Consent requirements: For all marketing communications, you must have verifiable opt-in consent. Transactional communications (order confirmation, shipping updates) may be sent to customers who have completed a purchase, provided you give recipients a clear opt-out mechanism.

5. Prohibited Content

The following content may not be sent through any ExecCortex messaging channel:

  • Adult or sexually explicit content
  • Gambling promotions (where not legally licensed to operate gambling services)
  • Cryptocurrency or investment opportunities without proper regulatory disclosure
  • Weapons, firearms, or related accessories (in jurisdictions where online sale is restricted)
  • Illegal drugs or drug paraphernalia
  • Counterfeit goods or services that infringe third-party intellectual property
  • Content that promotes violence, hate, or discrimination based on race, ethnicity, gender, religion, sexual orientation, or disability
  • Phishing, credential harvesting, or social engineering content
  • Content that violates any third-party platform's content policy (Meta, Google, WhatsApp, etc.)

6. AI Feature Restrictions

When using ExecCortex AI features (AI chat, workflow AI, insights AI), you must not configure the AI to:

  • Generate or distribute content that promotes illegal activity
  • Produce content designed to deceive, manipulate, or defraud users
  • Impersonate humans in a way that deceives users into believing they are speaking with a person when they are not (where applicable law requires AI disclosure)
  • Produce content that violates any prohibited content category above
  • Exceed the rate limits and fair-use thresholds of your connected AI provider accounts

ExecCortex reserves the right to review AI-generated content where there are reasonable grounds to suspect policy violations and to disable AI features without notice where violations are detected.

7. Platform Integrity

You must not use ExecCortex in any way that:

  • Overloads, disrupts, or degrades the performance of the platform or any connected system
  • Attempts to circumvent platform quotas, rate limits, or plan restrictions
  • Exploits bugs or security vulnerabilities instead of reporting them responsibly
  • Creates multiple accounts to circumvent free plan limits or enforcement actions

8. Reseller Obligations

Authorized ExecCortex resellers must ensure that all end customers comply with this AUP. Resellers are jointly responsible for AUP violations by their end customers. Reseller status may be revoked for repeated or serious violations by end customers.

9. Reporting and Enforcement

Reporting abuse: If you believe another user is violating this policy, report it to abuse@execcortex.com. We triage every report within 24 hours and aim to resolve within 7 business days.

Enforcement actions: Violations may result in any of the following, depending on severity:

  • Warning with a required remediation plan
  • Temporary suspension of specific features (e.g., messaging channels only)
  • Account suspension pending investigation
  • Permanent account termination without refund
  • Referral to Meta, Google, or WhatsApp Business Platform for policy action
  • Referral to law enforcement where illegal activity is suspected

Appeals: If your account is suspended, you may appeal within 14 days by emailing support@execcortex.com with evidence that the suspension was made in error. We will respond to appeals within 5 business days.

10. Changes to This Policy

We may update this Acceptable Use Policy to reflect changes in law, third-party platform requirements, or our assessment of emerging risks. We will provide 14 days' notice of material changes via email. Your continued use of ExecCortex after the effective date constitutes acceptance.
